These terms are an agreement between you (the parent, guardian, teacher or school using Mochilita) and Jay Bay Creates LLC ("we"). Children use Mochilita under the supervision of the adult who installed it, and that adult accepts these terms for them.
What Mochilita is. A learning app for practice at home and school. It does not replace a teacher, a school's English-learner program, or a speech, reading or learning evaluation. Placement checks, reading speeds and grade labels are practice guides, not official assessments.
Your license. We give you a personal, non-transferable license to use Mochilita on devices you own or control, for your family or your classroom. Don't copy, resell or redistribute the app or its content, or take out its pictures, sounds or voices to use elsewhere.
Purchases and refunds. If you buy Mochilita through an app store, that store's payment and refund rules apply.
Privacy. Our Privacy Policy explains that the app keeps everything on your device and sends nothing to us. It is part of these terms.
Your device and backups. Your child's progress lives only on your device. If the device is lost, reset, or the app or browser data is deleted, the progress is gone unless you saved a backup file. We can't recover it, because we never have it.
Things you add. Words, homework lists, writing and voice recordings you add stay yours. Only add material you have the right to use. Teachers who share word lists should not put students' personal information in them.
Grown-up areas. Settings, grown-up reports, backups, deletion and any link out of the app are behind a grown-up gate. Keep your PIN private.
Changes. We may update the app and these terms. If a change is significant, we will say so in the app store listing and update the date above. We will never change the app to collect children's personal information without first getting verifiable parental consent.
No warranty. Mochilita is provided "as is." We work hard to make the content accurate and age-appropriate but cannot promise it is free of errors. To the extent the law allows, we are not liable for indirect or consequential damages, and our total liability is limited to what you paid for the app.
Law. These terms are governed by the laws of North Dakota, USA, except where the law where you live gives you rights that can't be waived.
